LIABILITY RELEASE AND ASSUMPTION OF RISK

On this form “the company" shall mean WaterWorks Lda, trading as Fim do Mundo Safaris, as well as all affiliates, officers, agents, employees, directors and representatives (of any form) of the aforesaid parties.

I the undersigned hereby affirm that I am voluntarily engaging in the recreational activities planned for my trip with the company, which activities may include, but are not limited to, scuba diving, snorkeling, boating, kayaking and kitesurfing. If I engage in scuba diving, I affirm that I am a certified diver with experience deep diving (to thirty metres) and have dived within one year of undertaking this trip.

I am aware that skin and scuba diving have inherent risks which may result in serious injury or death and that these hazards include, but are not limited to, air expansion injuries, drowning, decompression sickness, slipping or falling while on board, being cut or struck by a boat while in the water, injuries occurring while getting on or off a boat, and other perils of the sea. I also understand that these activities are physically strenuous activities and that I will be exerting myself during this trip, and that if I am injured as a result of a heart attack, panic, hyperventilation etc, that I expressly assume the risk of said injuries. I certify that I am fully aware of and expressly assume all risks involved in the activities as listed above.

I understand and agree that the company may not be held liable or responsible in any way for any occurrence on this trip which may result in personal injury, property damage, death or other damages to me, my family, estate, heirs or assigns that may occur as a result of my participation in this trip or as a result of the negligence of any party, including the company, whether passive or active.
In consideration of me being allowed to participate in this trip, I hereby personally assume all risks and dangers, whether foreseen or unforeseen, in connection with said trip for any harm, injury or damage that may befall me while I am on this trip.

I further undertake to hold harmless and free the company from any and all claims and liability of whatsoever cause or nature which may arise as a result of a claim and/or action being made against it by any travel agent, booking agent or other agent relating in any way to a claim or action that I or my spouse, my common-law wife/husband, my children (whether minor or adult), my heirs, executors, administrators and assigns or any other dependant of mine may make.

In the event of an injury the company may at its discretion and without prejudice, or admission of liability, arrange and pay for emergency medical treatment and or transport for of and behalf of any client. In the event of the company having paid for emergency medical treatment and or transport for and on behalf of any client, then such client undertakes to refund such amounts to the company upon presentation of the necessary supporting documentation.

I understand that all trips are subject to the weather and the captain’s and/or dive leader’s decision is final.

I agree that any claims, be they in contract, delict or otherwise to be instituted against the company, shall be governed by the law of Mozambique and may only be instituted in a Mozambique Court, to the exclusion of all other jurisdictions.

I further state that I am of lawful age and legally competant to sign this Liability Release Agreement, or that I have obtained the written consent of my parent or guardian. I understand the terms herein are contractual and not a mere recital, and that I have signed this document of my own free will.

I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS LIABILITY RELEASE BY READING IT BEFORE SIGNING IT ON BEHALF OF MYSELF, FAMILY AND HEIRS.
